Green Oasis
The Green Oasis is a medical marijuana dispensary located on the Westside of Los Angeles near the borders of Playa Vista and Culver City. In September 2009, The Green Oasis Dispensary along with the Los Angeles Collective Association sued the city of Los Angeles after Green Oasis was not given the opportunity to obtain a permit to develop a new dispensary in the city. The Los Angeles County Superior Court ruled that L.A's medical marijuana moratorium violated the California Compassion Use Act, thus voting in favor of the Green Oasis dispensary.
== Court case ==
In July 2009, the city of Los Angeles effectively ended the hardship exemption of the cities marijuana ordinance. The city stated that all dispensaries opened after November 2007 must close immediately. The Green Oasis, represented by attorney Robert A. Kahn, sued the city on grounds that the ordinance was improperly implemented and was in essence void. Los Angeles superior court judge James Chalfant agreed and on October 22, 2009 the court granted the Green Oasis an injunction which barred the city from closing the establishment.
This unprecedented move halted the city’s efforts to close medical marijuana facilities city wide. This was the first time a medical marijuana facility successfully sued the city of Los Angeles. In December 2010 the Green Oasis along with over a dozen other collectives received another injunction against the city of Los Angeles. This time on constitutional grounds that medical privacy rights would be violated and that the pre-ordinance date of November 2007 was “arbitrary”. The city of Los Angeles is currently working on a third ordinance in an attempt to structure the cities legal marijuana trade. The Green Oasis was founded by Brian Berens in May 2009. Berens played a pivotal role in progressing the court case forward and keeping many marijuana dispensaries open and licensed by the city of Los Angeles.
